Terms of Service

Terms of Service for Whimsical Foam Parties 

Effective Date: March 1, 2024 

These Terms of Service (“Agreement”) are entered into by and between you (“Client” or “You”) and Whimsical Foam Parties, LLC, a North Carolina-based Limited Liability Company, doing business as Whimsical Foam Parties (“We”, “Us”, or “Our”). By booking a foam party with us, you agree to comply with and be bound by the following terms and conditions: 

  1. Booking and Payment 
  • All bookings must be made through our website or by contacting us directly. A deposit or full payment may be required to secure your reservation. ● Full payment is due before the event date, unless otherwise arranged. 
  1. Cancellations and Rescheduling 
  • Cancellations made at least 48 hours prior to the event will receive a full refund. ● Cancellations or rescheduling within 48 hours of the event will not be refunded but may be rescheduled at our discretion. 
  1. Event Requirements 
  • The client is responsible for ensuring the event space is suitable, safe, and has adequate drainage for foam use. 
  • If the event location is inaccessible or unsuitable, we reserve the right to refuse service. 
  • Additional requests or add-ons, such as foam color blasts or extra time, must be confirmed 48 hours in advance. 
  1. Liability and Insurance 
  • Whimsical Foam Parties, LLC is fully insured. However, clients agree to assume responsibility for any damages, injuries, or accidents that occur during the event.
  • We are not liable for property damage or injury resulting from foam use. 5. Additional Charges 
  • Additional charges may apply for extra time beyond the booked duration, special add-ons (e.g., bubble machine or color blasts), and any extra services requested during the event. 
  • A full list of add-ons and their prices is available on our booking page. 6. Modifications to the Event 
  • In cases of extreme weather or other unforeseen circumstances, we reserve the right to modify or cancel the event. Clients will be offered the option to reschedule or receive a refund. 
  • Any modifications to the event must be discussed and confirmed by both parties in writing. 
  1. Client Conduct 
  • The client agrees to ensure that all participants behave appropriately during the event. Any disruptive or unsafe behavior may result in the termination of the event without refund. 
  1. Indemnity 
  • You agree to indemnify and hold harmless Whimsical Foam Parties, LLC, its employees, agents, and affiliates from any claims, damages, or losses arising from your use of our services. 
  1. Changes to Terms of Service 
  • We may update these Terms of Service from time to time. Any changes will be posted on this page, and the updated terms will reflect the new effective date. Continued use of our services after changes are posted will signify your acceptance of the updated terms.
